Terms of Service

These Terms of Service ("Terms") govern your use of OneStudio (the "Service"). By creating an account or using the Service you agree to these Terms. If you don't agree, don't use the Service.

1. The Service

OneStudio is an AI content creation and marketing platform. You can generate and edit images, video, and audio, build brand kits, and produce marketing content with our storyboard, prompt, and editor tooling. Our Marketing Studio can also publish and schedule the content you create to social accounts you connect (for example YouTube and other networks), and send messages to contacts you provide (for example WhatsApp broadcasts). We rely on third-party model providers (ByteDance, Kling AI, OpenAI, Google, Runware, and others) to perform generation, and on third-party platforms to deliver publishing and messaging.

2. Your Account

You are responsible for keeping your credentials secure and for everything that happens under your account. You must be at least 13 years old (16 in the EEA) to create an account. One person per account; sharing logins is not allowed for paid plans.

3. Acceptable Use

OneStudio is for commercial and creative work. It is not a tool for sexual content, and it may not be used to depict any real person intimately or sexually without their consent. Our Acceptable Use Policy sets out these rules in full.

You agree not to use the Service to create or distribute content that:

• Constitutes non-consensual intimate imagery (NCII) — intimate, nude, or sexually explicit depictions of a real person, created or shared without that person's consent, including imagery generated from their photographs.
• Sexualizes a minor, real or generated, in any way.
• Removes, replaces, or alters clothing on an image of a real person, or otherwise sexualizes someone without their consent.
• Is pornographic or sexually explicit.
• Impersonates real people in a defamatory, harassing, sexual, or deceptive context without their consent (deepfakes).
• Promotes terrorism, organized violence, or graphic real-world gore.
• Incites violence, harassment, or hatred against a protected class.
• Infringes a third party's intellectual property or publicity rights.
• Violates applicable law, including export controls and sanctions.

We may suspend or terminate accounts that violate this section, and may share evidence of illegal activity with law enforcement.

3.5 Connected Accounts & Publishing

The Service lets you connect your own third-party accounts (such as social networks, YouTube, and messaging platforms) so OneStudio can publish, schedule, or send the content you create on your behalf.

• You authorize OneStudio to act on your behalf only for the actions you initiate, such as publishing or scheduling the content you create and sending the messages you compose. You can disconnect any account at any time, which revokes that access.
• You are responsible for the content you publish or send and for complying with each connected platform's own terms and policies, including the YouTube Terms of Service and the policies of any messaging platform you use.
• For messaging features, you represent that you have the necessary consent to contact the recipients you add, and that your use complies with applicable anti-spam, privacy, and marketing laws. You must not send unsolicited, deceptive, or prohibited messages.

OneStudio's use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. See our Privacy Policy for details on the data we access and store.

4. Ownership of Output

Subject to your compliance with these Terms and any applicable third-party model licenses, you own the generated images and videos you create with the Service for your own commercial and non-commercial use. You grant OneStudio a limited license to store, process, transmit, and serve back your content as needed to deliver the Service.

Generated outputs are produced by third-party models we don't control. We make no warranty that any given output is free from third-party IP or that any given prompt is safe to use commercially.

5. Billing & Tokens

Subscription plans renew monthly or annually until cancelled. Token packs are consumed on a metered basis when you generate content. Tokens are non-refundable except where required by law. Pricing may change with 30 days' notice.

6. Termination

You may close your account at any time. We may suspend or terminate your access for material breach, illegal activity, prolonged inactivity, non-payment, or business reasons (with reasonable notice). On termination we may delete your content after a grace period.

7. Disclaimers

The Service is provided "as is" without warranty of any kind. We don't warrant uptime, accuracy of generated outputs, fitness for a particular purpose, or non-infringement. AI models can produce inaccurate, biased, or surprising results, so review every output before publishing.

8. Limitation of Liability

To the maximum extent permitted by law, OneStudio's aggregate liability under these Terms will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

9. Indemnity

You agree to indemnify and hold harmless OneStudio from any claim arising out of content you create with the Service or your violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the jurisdiction where OneStudio is incorporated, excluding its conflict-of-law rules. Any dispute will be resolved in the courts of that jurisdiction unless local consumer-protection law requires otherwise.

11. Changes

We may update these Terms. We'll post the updated version here and email registered users on material changes. Continued use after the effective date constitutes acceptance.
